NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  PURCHASE DOES NOT INCREASE ODDS OF WINNING. This Contest is open only to individuals ("Entrants") who are legal residents of the 50 United States and the District of Columbia that are or will be at least 18 years of age at the time of entry. If you are not a permanent resident of the United States or you are not the required age as of time of entry, you are not eligible to participate in this Contest or to win a prize. Void outside participating Station’s Total Market Area (TMA) and where prohibited or restricted by law. Odds of winning depend upon the number of eligible entries received during the Contest Period. THIS CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW.  DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

Clear Channel Broadcasting, Inc., its subsidiaries, affiliated companies and divisions to include individual Stations, iHeartRadio and Clear Channel Media+ Entertainment (collectively, the “Company”), will conduct its promotional contests substantially as described in these official contest rules. “Contest Entities” shall be collectively referred to herein and shall mean any party or entity associated in any way with the Contest, including but not limited to the Contest administrator, individual Stations, the Contest’s sponsoring organizations, any third party prize provider(s) and or prize fulfillment service, Clear Channel Broadcasting, Inc., (Company), and each of the foregoing’s respective parents, subsidiaries, affiliates, officers, directors, employees, talent, artists, volunteers and contractors of each individual foregoing parties.

By participating, each participant agrees as follows: The Company may from time to time conduct contests concurrently and simultaneously on several participating radio stations owned and not owned by the Company, and in various States, and the Company may add or remove participating stations or change call letters of any participating station at any time during a contest as announced on the affected station.  Participating stations are listed above. For a list of participating stations and/or a copy of the official contest rules, please visit the office of the participating station during normal business hours or send your request to as instructed herein.

The Contest is administered by the Company and any questions, comments or complaints regarding the Contest must be directed to the contest administrator. Entrant(s) (and if eligible minors, their parents/legal guardians) agrees to and acknowledges that any information provided will be used for administering the Contest and in accordance with Clear Channel privacy practices found here.

1. Description of Contest/Participation:  

A. Date(s) of Contest: Contest will begin February 25, 2013 at 6:00 AM/EST and end March 18, 2013 at 6:00am/EST. (“Contest Period”). 

B. How To Play:

On-Line

Within the Contest dates a pair of Classic Rock artist(s)/band(s) will be set against one another. Listeners/registrants/contestants (together, the “Player”) will have the ability to pick/choose/select (together, the “Vote”) their favorite by logging onto the Station’s website at www.big1059.com in order to gain points for the Contest between starting and ending at 6:00 AM/EST. 

Player’s points will be acquired once the day’s Voting has ended and an artist/band has been clearly established. Those that have Voted for the winning artist/band will be awarded a preset number of points for that round. The point system will increase throughout the Contesting rounds. At the end of the contest on March 18th , 2013 at 6:00 AM/EST; one (1) random winner will be chosen from all high scorers and ten (10) runner-ups will be chosen.

At the end of the competition the Player with the highest score will win the grand prize. Winner may not substitute or transfer all or any portion of any prize(s) herein contained within this Contest. 

If a Vote cannot be entered because the "action" to results in the "answer" is canceled, forfeited, or indefinitely suspended for any reason, or if there proves to be two correct listed answers for the question, that question shall not count for any contestant and scores will be computed as if the question did not exist.  All results posted are unofficial until winners respond to e-mail notification. The points for each question are clearly marked. For an individual round: The computer takes all the fans that are tied and orders them randomly. For the overall winner: Fans answer a tie-breaker question for the last round. The computer then takes all the fans tied and then checks to see how accurately they answered the tie-breaker question. If there are still ties the computer orders the fans randomly. All decisions of the judges are final.

Entries are subject to any applicable restrictions or eligibility requirements listed herein.  Entries will be deemed made by the authorized account holder of the email or telephone phone number submitted at the time of entry and qualification. Use of any device to automate entry is prohibited.  The Company is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. Company is not responsible for lost, late, illegible, misdirected, mutilated, postage-due or incomplete entries or mail. Multiple participants are not permitted to share the same email address.  Should multiple users of the same e-mail account or mobile phone number, as applicable, enter the Contest and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said e-mail account or mobile phone account at the time of entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address or mobile phone number by an Internet access provider, on-line service provider, telephone service provider or other organization which is responsible for assigning e-mail addresses, phone numbers or the domain associated with the submitted e-mail address. Proof of submission of an entry shall not be deemed proof of receipt by the website administrator for online entries. When applicable the website administrator’s computer will be deemed the official time keeping device for the Contest promotion.  Contest entries must contain all information requested and must be received on or before the deadline for registration to be deemed valid. All Entries become the property of Company and will not be receipt acknowledged or returned.

The prize(s) that may be awarded to the eligible winner(s) are not transferable, redeemable for cash or exchangeable for any other prize.  All prizes must be redeemed from the Station within 30 days of the contest end date unless otherwise stated in the contest’s official rules.  Certain prizes are date specific (i.e. concerts, trips) and the winner or winners must be available on the dates specified.  If a winner is unreachable after seven (7) days, is disqualified for any reason or if that winner is unavailable for prize fulfillment the Company reserves the right to determine an alternate winner or not to award that winner’s prize in its sole discretion. The Company reserves the right to substitute all or any portion of any prize with a prize of equal or greater value. All final determinations shall be made by Clear Channel Media and Entertainment and its decisions are final and binding with respects to all aspects of this Contest.

3.  Eligibility and Limitations:

Participants and winner(s) must be U.S. residents at least 18-years old as determined by the Company and reside in the Station’s Total Survey Area (TSA). If the contest is open to minors, a parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but the Company reserves the right to refuse to award a prize to or on behalf of any minor.  Unless otherwise stated in the official contest rules, only one (1) entry per person.  Only one (1) prize valued less than $250 per household for the Contest for any thirty (30) day period.  Only one (1) prize valued more than $250 per household for the Contest for any ninety (90) day period.  If the contest involves listener participation by voting for a contest participant on the station’s website then the voting is limited to one vote per person.  If a contestant receives multiple and/or irregular votes from the same user or users, regardless of the source, the Station reserves the right to disqualify the contestant in its sole discretion.  Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win.  The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

4. Telephone and Delivery Disclaimer:

 If a contest is a call in to win contest and/or a telephone is needed to participate in the Contest, participants are restricted to the use of ordinary telephone equipment.  Participants that enable the “Caller ID” block function will not be allowed to participate unless they enter their correct area code and telephone number if prompted, or disable the features inhibiting their participation in the Contest.  Participants using equipment not set up for toll free phone exchanges (800, 888, 877, 866, etc.) may experience call connection problems.  The Company disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company’s control, or otherwise.  For all contests the Company disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method.  The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including:  failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Furthermore The Company is not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God. Entry forms in a register-to-win contest must be handwritten.  No photocopies or mechanical reproductions of entry forms are permitted. 

5. Publicity; Use of Personal Information: 

By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use.  By participating in the Contest, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. 

6.  Consumer Created Content: 

IF THE ENTRY FOR THE CONTEST INCLUDES ANY CREATIVE MATERIAL FROM THE PARTICIPANT, INCLUDING BUT NOT LIMITED TO, CONSUMER CREATED CONTENT, BY ENTERING THE CONTEST EACH PARTICIPANT IS VERIFYING THAT (1) YOU ARE THE OWNER AND PRODUCER OF THE SUBMITTED MATERIAL AND THAT NO THIRD PARTY OWNERSHIP RIGHTS EXIST TO ANY MATERAIL SUBMITTED, AND (2) YOU ARE HEREBY GRANTING THE COMPANY AND THIS STATION A PERPETUAL, WORLDWIDE, NON-EXCLUSIVE, ROYALTY-FREE, SUB-LICENSABLE (THROUGH MULTIPLE TIERS) RIGHT AND LICENSE TO USE, PUBLISH, REPRODUCE, DISPLAY, PERFORM, ADAPT, MODIFY, DISTRIBUTE, HAVE DISTRIBUTED AND PROMOTE SUCH CONTENT IN ANY FORM, IN ALL MEDIA NOW KNOWN OR HEREINAFTER CREATED, ANYWHERE IN THE WORLD, FOR ANY PURPOSE. 

7. Release: 

By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize.  In order to receive a prize, participants must sign an official waiver form provided by the Company.

8. Taxes: 

Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules.  Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.  Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

9. Conduct and Decisions: 

By participating in the Contest, participants agree to be bound by the decisions of Company personnel.  Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified.  Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.  The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final.  If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate.  All decisions will be made by the Company and are final.  The Company may waive any of these rules in its sole discretion. 

10. Miscellaneous:

Void where prohibited.  Odds of winning depend upon the number of participants.  Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize.  The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s).  The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.  For a copy of the rules, or where required by law, a list of winners, visit the business office of the Station during normal business hours or visit the Station’s website.  All entries become the property of the Company and will not be returned. 

11. Compliance with Law: 

The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein.  Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.

 No purchase necessary. One valid entry per contestant.

 You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.

 Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If Upickem or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.

 Odds of winning depend on the number of eligible entries received.

 Upickem and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.

 Affiliates reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.

 Employees of Upickem and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.

 Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.

 Entrants further grant to Upickem and its affiliates the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.

 Upickem and its affiliates reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.

 The Contest and all of the related pages, contents and code are copyright, Upickem, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

 Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.

 Upickem and its affiliates are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.

 If a question cannot be answered because the "action" to result the "answer" is canceled, forfeited, or indefinitely suspended for any reason, or if there proves to be two correct listed answers for the question, that question shall not count for any contestant and scores will be computed as if the question did not exist.
